These terms and conditions ("Terms") govern your use of the services offered through the 'website' [www.dupotan.in] (referred to as the "Platform") as well as the services provided on or through the Platform (collectively referred to as the "Services"). These Terms also include our privacy policy available at [https://dupotan.in/privacy] and any additional guidelines, terms, policies, and disclaimers issued from time to time ("Supplemental Terms"). The Privacy Policy and Supplemental Terms form an integral part of these Terms. In case of any conflict between these Terms and the Supplemental Terms concerning the applicable Services, the Supplemental Terms will prevail.

These Terms constitute a legally binding agreement between Dupotan Services (referred to as "Dupotan," "we," "us," or "our"), located at Chhatarpur, Yes Bank, Delhi, 110030, and you, as a user of the Services or a legal entity booking Services on behalf of end-users (referred to as "you" or "User"). By using the Services, you confirm that you have the legal capacity and authority to agree to and be bound by these Terms. If you represent another person or entity, you warrant that you have the authority to bind them to these Terms.

By using the Services, you acknowledge, understand, and agree to abide by these Terms, as amended periodically. These Terms override any prior agreements. If you do not agree with these Terms or cannot comply with them, please refrain from using the Services.

"By submitting our webform or booking Services, you agree to receive promotional calls and communications on the number shared. Such communication and SMS may come from a third-party platform."
 

1. Services
 

(a) The Services include:

​

(i) Providing a technological Platform that facilitates subscription-based arrangements for housemaids, cooking maids, babysitters, caretakers, and all-rounder services with independent third-party service providers ("Helpers").

​

(ii) Offering additional perks, information, and accessories related to Helpers, subject to availability and feasibility, such as:

  • Background check,

  • Aadhar Verification Report of Helpers,

  • Background Verification Report of Helpers,

  • Training/Assessment of Helpers for job-specific and soft skills (if required),

  • Uniforms for Helpers,

  • Transportation for Helpers (for full-time/live-in Helpers only),

  • Information about Dupotan Biker (for Helpers availing daily pick-up and drop services for daytime workers),

  • Replacement Guarantee for Helpers as per the refund and replacement policy detailed in Clause 7 of these Terms.

(iii) Facilitating payments to Helpers for their services and handling payment collection on behalf of Helpers, as agreed by both Helper and User.

​

(b) The term "Helper Services" refers to the services provided by Helpers, such as housemaids, cooking maids, babysitters, and similar roles. It is important to note that "Services" specifically refer to those provided by Dupotan, not the Helper services. Dupotan solely offers the Platform and Services and is not responsible for the Helper services. Helpers are exclusively responsible for the services they provide, and any recourse for the Helper services lies with the Helper(s). Helpers are not employees, agents, contractors, or partners of Dupotan and cannot represent or bind Dupotan in any manner.

The terms of the Helper services are subject to an agreement between you and the Helper.

(c) The Platform is intended for personal, non-commercial use unless otherwise agreed upon between you and Dupotan through a separate agreement. The Platform is designed for use within India.

​

(d) As part of the Services, you may receive communications (via text, WhatsApp, email, etc.) regarding your bookings, subscriptions, usage of Services, as well as promotional or marketing messages.

​

(e) You may be required to provide identification proof to access the Services or Helper services. Failure to comply may result in the denial of Services or Helper services and could lead to your account being restricted or banned.

2. Account Creation

​

(a) To use our Services, you must create an account on our Platform (www.dupotan.in) by providing accurate information, including your address, household details, and contact number. You must be at least 18 years old.

​

(b) You are responsible for maintaining the security and confidentiality of your account and promptly updating your information. Dupotan is not liable for unauthorized access or activities under your account.

​

(c) By using the Services, you consent to receive communications from us related to bookings, payments, and promotions.

​

3. User Content

​

(a) Users may submit reviews, suggestions, or feedback about Helpers and Services. Reviews must be accurate and not misleading.

​

(b) Dupotan may remove content that violates these Terms and reserves the right to suspend or terminate accounts if inappropriate content is posted.

​

(c) By submitting content, you grant Dupotan a royalty-free, worldwide license to use and display it for service improvement and promotional purposes.

​

4. Consent to Use Data

​

(a) By using our Services, you consent to our collection and use of your personal data as outlined in our Privacy Policy (www.dupotan.in/privacy).

​

(b) Your data may be shared with third parties for service provision, analytics, and legal compliance.

​

5. Bookings and Subscriptions

​

(a) Bookings: Users can request Helpers on a subscription basis ( 11 months). Booking Fees and Subscription Fees are applicable and payable as per the Platform instructions.

​

(b) Cancellations and Replacements: Refunds for cancellations and replacements are governed by our Refund and Replacement Policy.

​

6. Pricing, Fees, and Payment Terms

​

(a) Fees: Dupotan charges a Subscription Fee before arranging the Helper.

​

(b) Helper's Salary: Paid directly to the Helper monthly. Dupotan only facilitates fee collection for Helpers upon mutual agreement.

​

(c) Payments for Booking Fees and Subscription Fees are non-refundable, except as per applicable laws or Dupotan’s discretion.

​

(d) All fees are subject to applicable taxes. Changes in fees do not affect confirmed bookings.

​

7. Refund and Replacement Policy

​

  1. Replacements:

    • Replacements are available during the subscription period for valid reasons (e.g., Helper not working, frequent absences, or skill/behavior issues). Discriminatory reasons (religion, caste, gender, etc.) will not be entertained.

    • Replacement charges for 24-hour live-in Helpers:

      • Delhi: ₹399per pick-and-drop

      • Gurgaon/Noida: ₹499 per pick-and-drop

  2. Timelines:

    • Replacements take 1–10 working days for part-time Helpers and 15–20(may vary) working days for full-time Helpers.

  3. Refunds:

    • 75% of Subscription fees are refundable within 15 days of use. 

    • 25% Subscription fee will be considered as cancellation charge if Subscription is cancelled within 15 days of use.

  4. Conditions:

    • Job descriptions for replacements must remain consistent. Changes require a new booking.

    • Refunds will be issued as Credit Notes, valid for 6 months.

    • No refunds or replacements for mistreatment, relocation without notice, or mid-service cancellations.

      Please note: Before a replacement can be processed, all outstanding dues, including any wages owed to household staff for services rendered, must be paid in full. This policy is in place to maintain efficient operations and ensure fair treatment for everyone.

8.  User Conduct

​

  1. Treat Helpers with courtesy and provide a safe working environment. Helpers may refuse service if safety or respect is compromised.

  2. Discrimination based on religion, caste, color, or gender is strictly prohibited.

  3. Report inappropriate Helper behavior within 48 hours.

  4. Do not directly solicit Helpers outside Dupotan services.

 

9. Responsibilities

​

  1. Provide accurate information for bookings and notify Dupotan of any changes.

  2. Use services responsibly and comply with all legal and ethical standards.

  3. Avoid actions that harm Dupotan systems or breach terms, including unauthorized access or content misuse.


10. Our Intellectual Property

​

(a) Ownership: All rights to the Services, including intellectual property, are owned or licensed by Dupotan. We grant you a limited, revocable, non-transferable license to use the Services in compliance with these Terms.


(b) Feedback: Any feedback or suggestions you provide may be used by Dupotan without any obligation for acknowledgment or compensation.


(c) IP Limitation: These Terms do not grant any additional rights to our intellectual property unless explicitly stated.

11. Term and Termination

​

(a) Term: These Terms remain valid unless terminated.


(b) Our Termination Rights: Dupotan may terminate your access for breach of Terms, legal requirements, or other legitimate reasons.


(c) User Termination: You may terminate services by notifying us at support@dupotan.in.


(d) Post-Termination: Upon termination, your account access will be restricted.

12. Disclaimers and Warranties

​

(a) Service "As Is": Services are provided without guarantees or warranties. Dupotan is not liable for any issues arising from service use.


(b) Helper Services: Dupotan does not guarantee the quality or reliability of Helpers and is not responsible for their actions.


(c) User Risk: Use of the Services and Helper services is at your own risk.


(d) Limited Liability: Dupotan is not responsible for indirect, incidental, or consequential damages.

13. Indemnity

​

You agree to indemnify Dupotan against claims, losses, and liabilities resulting from your use of the Services or breach of Terms.

​

14. Jurisdiction, Governing Laws, and Dispute Resolution

​

(a) Jurisdiction: These Terms are governed by Indian laws under the jurisdiction of Delhi courts.


(b) Arbitration: Disputes will be resolved through arbitration in Delhi under the Arbitration and Conciliation Act, 1996.

15. Grievance Redressal

​

For complaints or queries, contact our Grievance Officer at support@dupotan.in.

​

16. Direct Employment Restriction

​

Helpers introduced by Dupotan cannot be employed directly without renewing or paying a subscription. Violation may result in legal action.

17. Miscellaneous Provisions

​

(a) Changes to Terms: Updates to Terms will be posted on www.dupotan.in and are effective immediately.


(b) Modification of Services: Dupotan may modify or discontinue Services at any time.


(c) Severability: If any provision is invalid, the remaining Terms remain enforceable.


(d) Assignment: You may not transfer rights; Dupotan may assign its rights.


(e) Notices: Official notices must be sent to support@dupotan.in.


(f) Third-Party Rights: No third party gains rights under these Terms.


(g) Force Majeure: Dupotan is not liable for events beyond its control.
